Tax penalty to hit nearly 6M uninsured Americans

WASHINGTON (AP) ? Nearly 6 million Americans ? significantly more than first estimated? will face a tax penalty under President Barack Obama's health overhaul for not getting insurance, congressional analysts said Wednesday. Most would be in the middle class.

The new estimate amounts to an inconvenient fact for the administration, a reminder of what critics see as broken promises.

The numbers from the nonpartisan Congressional Budget Office are 50 percent higher than a previous projection by the same office in 2010, shortly after the law passed. The earlier estimate found 4 million people would be affected in 2016, when the penalty is fully in effect.

That's still only a sliver of the population, given that more than 150 million people currently are covered by employer plans. Nonetheless, in his first campaign for the White House, Obama pledged not to raise taxes on individuals making less than $200,000 a year and couples making less than $250,000.

And the budget office analysis found that nearly 80 percent of those who'll face the penalty would be making up to or less than five times the federal poverty level. Currently that would work out to $55,850 or less for an individual and $115,250 or less for a family of four.

Average penalty: about $1,200 in 2016.

"The bad news and broken promises from Obamacare just keep piling up," said Rep. Dave Camp, R-Mich., chairman of the House Ways and Means Committee, who wants to repeal the law.

Starting in 2014, virtually every legal resident of the U.S. will be required to carry health insurance or face a tax penalty, with exemptions for financial hardship, religious objections and certain other circumstances. Most people will not have to worry about the requirement since they already have coverage through employers, government programs like Medicare or by buying their own policies.

A spokeswoman for the Obama administration said 98 percent of Americans will not be affected by the tax penalty ? and suggested that those who will be should face up to their civic responsibilities.

"This (analysis) doesn't change the basic fact that the individual responsibility policy will only affect people who can afford health care but choose not to buy it," said Erin Shields Britt of the Health and Human Services Department. "We're no longer going to subsidize the care of those who can afford to buy insurance but make a choice not to buy it."

The budget office said most of the increase in its estimate is due to changes in underlying projections about the economy, incorporating the effects of new federal legislation, as well as higher unemployment and lower wages.

The Supreme Court upheld Obama's law as constitutional in a 5-4 decision this summer, finding that the insurance mandate and the tax penalty enforcing it fall within the power of Congress to impose taxes. The penalty will be collected by the IRS, just like taxes.

The budget office said the penalty will raise $6.9 billion in 2016.

The new law will also provide government aid to help middle-class and low-income households afford coverage, the financial carrot that balances out the penalty.

Nonetheless, some people might still decide to remain uninsured because they object to government mandates or because they feel they would come out ahead financially even if they have to pay the penalty. Health insurance is expensive, with employer-provided family coverage averaging nearly $15,800 a year for a family and $4,300 for a single plan. Indeed, insurance industry experts say the federal penalty may be too low.

The Supreme Court also allowed individual states to opt out of a major Medicaid expansion under the law. The Obama administration says it will exempt low-income people in states that opt out from having to comply with the insurance requirement.

Many Republicans still regard the insurance mandate as unconstitutional and rue the day the Supreme Court upheld it.

However, the idea for an individual insurance requirement comes from Republican health care plans in the 1990s.

It's also a central element of the 2006 Massachusetts health care law signed by then-GOP Gov. Mitt Romney, now running against Obama and promising to repeal the federal law.

Romney spokeswoman Andrea Saul said Wednesday the new report is more evidence that Obama's law is a "costly disaster."

"Even more of the middle-class families who President Obama promised would see no tax increase will in fact see a massive tax increase thanks to Obamacare," she said.

Romney says insurance mandates should be up to each state. The approach seems to have worked well in Massachusetts, with virtually all residents covered and dwindling numbers opting to pay the penalty instead.

World Bank warns of deepening Palestinian fiscal crisis

RAMALLAH, West Bank (Reuters) - A fiscal crisis in the aid-dependent Palestinian economy will worsen unless foreign funding increases and Israel eases its restrictions in the occupied West Bank, the World Bank said on Wednesday.

"Donors do need to act urgently in the face of a serious fiscal crisis facing the PA (Palestinian Authority) in the short term," Mariam Sherman, the World Bank's country director for the West Bank and Gaza Strip, said in a statement.

In a report issued ahead of a conference on Palestinian aid in New York next week, the World Bank forecast a $1.5 billion deficit in the PA budget in 2012. It said only $1.14 billion in donor funding to cover the gap had been received.

The PA, which exercises limited self-rule in the West Bank, receives most of its aid from the United States, the European Union and Arab nations.

But over the past several years there has been a shortfall in aid coming from Arab states resulting in the PA being unable to pay salaries to its 153,000 civil servants on time, on several occasions this year.

A hike in taxes in early September caused by economic accords with Israel that peg Palestinian sales tax to high Israeli rates sparked demonstrations in West Bank cities and calls for the government to resign.

To appease the crowds and end protests, Prime Minister Salam Fayyad announced a rolling back of the tax increases.

The report said the presence of Israeli settlements, which control some 42 percent of West Bank territory, was stifling the potential for Palestinian economic growth.

To build their economy, the World Bank said, the Palestinians need access to "Area C", the territory covering 60 percent of the West Bank where Israel maintains full control under interim peace accords and most settlements are located. Area C includes most of, but not all, the settlements.

"The continuous growth in the size of land that is allocated for settlement activity within the West Bank has fragmented the territory into smaller and more disconnected enclaves," the report said.

The United Nations deems all settlements in the West Bank to be illegal. Israel disputes this and has sanctioned 120 official settlements since capturing the West Bank in a 1967 Middle East war.

In the report, the World Bank forecast that Gross Domestic Product growth in the West Bank and the Gaza Strip would slow to 5.6 percent in 2012 from 5.9 percent last year.

BARRIERS

Sherman said that even if donor countries met their aid pledges, "sustainable economic growth cannot be achieved without the removal of the barriers preventing private sector development, particularly in Area C".

The World Bank said the PA had made "credible efforts", towards tackling its crisis and building its institutions but Israeli measures "remain the major impediment."

Sherman cited difficulties in obtaining Israeli entry permits to the West Bank for foreign investors, a ban on the import of "dual use" items that Israel fears could be used in weaponry and limits on access to natural resources.

"The most important message of this report is that economic cohesion is not achievable when the areas in which people have to operate and go about their business are crisscrossed by impediments," Sherman said.

The report said Israel has recently shown a willingness to consider the relaxation of specific restrictions in Area C, and had, according to its Foreign Ministry, approved 119 Palestinian infrastructure projects in 2011.

Israel has said it has greatly eased the movement of people and goods in the West Bank, as a result of improved security conditions. It maintains a blockade of the Gaza Strip, whose rulers oppose the existence of the Jewish state.

NEW YORK (AP) ? Barbra Streisand, Aretha Franklin and Liza Minnelli took turns singing songs by the late Marvin Hamlisch during a stirring memorial service for the composer on Tuesday.

Minnelli sang "If You Really Knew Me" from the musical "They're Playing My Song," Franklin gave a soulful rendition of "Nobody Does It Better" from the James Bond film "The Spy Who Loved Me" and Streisand brought the crowd to its feet when she finished "The Way We Were" from the film of the same name.

The composer's wife of 26 years, Terre Hamlisch, welcomed the crowd.

"These are Marvin's melodies," she said. "Marvin Hamlisch lives in them. This is who Marvin Hamlisch was."

Hamlisch composed or arranged hundreds of scores for musicals and movies, including "A Chorus Line" on Broadway and the films "The Sting," ''Sophie's Choice," ''Ordinary People" and "The Way We Were." He died on Aug. 6 in Los Angeles at age 68 after a short illness.

Streisand, who wore all black and sat on a stool, said she first met Hamlisch in 1963 when he was her rehearsal pianist in her breakout Broadway show, "Funny Girl." He also was tasked with getting everyone coffee.

Since Streisand didn't drink coffee, he would bring her chocolate doughnuts.

"He always brought me two, and so our love affair began," Streisand said as the crowd laughed.

Their lives would intersect in personal and professional ways over the years. She sang his "The Way We Were" to a Grammy Award win in 1974, and he played at her wedding in 1998.

Franklin, in a white suit, changed some of the lyrics to the sexy James Bond song "Nobody Does It Better," to "Marvin, you were the best." Hamlisch had co-written the No. 1 R&B hit "Break It to Me Gently" with Carole Bayer Sager for Franklin.

Minnelli, in a beaded dress, said she met Hamlisch when she was 14 and he was 15 and they became friends immediately. He later arranged many of Minnelli's albums, including her first two as well as "Judy Garland & Liza Minnelli 'Live' at the London Palladium."

"He was one of my few constants," she said, getting teary on stage. "He was always there. He always was and always will be."

There were few seats available in the 900-seat theater at The Juilliard School, where decades before Hamlisch had become its youngest person accepted at just age 7. His widow urged the crowd to fund scholarships in his memory.

Hamlisch went on to became one of the most decorated artists in history, winning three Oscars, four Emmys, four Grammys, a Tony, a Pulitzer and two Golden Globes.

The 90-minute memorial, which also boasted performances by Itzhak Perlman, Michael Feinstein, Chris Botti and Maria Friedman, took place on a stage dominated by a huge photo of Hamlisch and two towers of flowers on either side. Performers would blow the photo kisses or bow to it after their turns on stage.

In the audience were Mike Nichols, the Oscar- and Tony-winning director, and Valerie Jarrett, a longtime adviser and friend to Barack and Michelle Obama.

Hamlisch's funeral was held Aug. 14 at Congregation Emanu-El, a prominent Manhattan synagogue where legendary songwriter George Gershwin's funeral was held in 1937. Former President Bill Clinton and Sir Howard Stringer, chairman of Sony Corp., eulogized Hamlisch.

Hamlisch received a Tony and a Pulitzer for "A Chorus Line," the second-longest-running American show in Broadway history, and wrote the music for other stage hits such as "The Goodbye Girl" and "Sweet Smell of Success."

He was working on a new musical, "Gotta Dance," at the time of his death and was scheduled to write the score for a new Steven Soderbergh film on Liberace, "Behind the Candelabra," starring Michael Douglas and Matt Damon.

The memorial also included the song "While I Still Have the Time," which is part of the new musical based on the Jerry Lewis film "The Nutty Professor" that debuted in Tennessee this summer.
